Version 2026-08-27. These terms govern the Giant Maker Partner Program. Applying doesn't guarantee acceptance — Kyle reviews every partner personally, and approval is at our discretion.
1. What the program is
You send people to your partner page. They request a free website audit. We do the audit, and if that turns into paid work, you get paid a share of it.
You are an independent contractor. This isn't employment, a partnership, or a franchise, and neither of us can bind the other to anything.
The program is currently open to US-based partners only. That is a payment and tax-reporting limitation, not a judgement about anyone — our payouts and our tax reporting are set up domestically for now. If you're outside the US and want in, email us anyway and we'll tell you honestly where it stands.
2. How you get paid
You earn 20% of the scoped price of project work we sell to a client you referred, on any project they start within 12 months of becoming a client.
The detail that matters:
- Scoped project work only. A defined piece of work with a price on it — a website build, a rebrand, a campaign. If we quote $10,000, you earn $2,000.
- Retainers and subscriptions are excluded. Ongoing monthly work, management fees, hosting, software — none of that carries commission. This program pays for bringing us projects.
- 12 months from when they become a client, not from the click. Every scoped project they start in that window earns you 20%; after it, they are simply our client.
- Pass-through costs are excluded — ad spend, software licences, printing, and anything else we bill at cost. Commission is on our fee.
- Paid once we have been paid. If a project is billed in stages, your commission follows the money as it arrives, not the signature. We are not asking you to carry our collection risk, and we are not paying out on money that never came in.
3. How a referral gets credited to you
- Someone clicks your partner link. We set a tracking cookie that lasts 90 days.
- If they request an audit within those 90 days, that audit is attributed to you.
- Last click wins. If someone clicks two partners' links, the most recent one before the audit request gets the credit.
- If someone comes to us with no cookie but names you unprompted, tell us — we'd rather credit you than be technically correct.
- Cookies get cleared and people switch devices. We'll be reasonable about genuine disputes, but our tracking records are what we go on.
4. When money actually moves
- Paid monthly, on the 15th, for commission that became payable in the previous month.
- $50 minimum. Below that it rolls forward until you cross it.
- Paid electronically to the payment details on your partner profile. Keep them current — we cannot chase a payout that bounces.
- We need a completed W-9 from you before your first payout. You fill it in and sign it right in your partner dashboard — there is nothing to print, and nothing to email anyone.
- US partners earning $600 or more in a calendar year get a 1099-NEC. Payouts are held until a valid W-9 is on file. Tax on what you earn is yours to handle. You are an independent contractor, not an employee, and we withhold nothing.
5. Refunds and clawbacks
If a client refunds, charges back, or a payment reverses, the commission on it comes back — deducted from your next payout, or invoiced if there's no next payout. We'll always tell you why.
6. What you may not do
This is the part that gets people removed, so it's short and specific.
- No spam. No unsolicited email, DMs, texts, or comment-section drops. Anything you send has to comply with CAN-SPAM and its equivalents.
- No bidding on our brand. Don't run paid search on "The Giant Maker", "Giant Maker Almanac", or close variants.
- Don't pretend to be us. No lookalike sites, no impersonating our staff, no implying you're an employee, no registering domains or social handles containing our name.
- No promised results. Don't claim specific revenue, rankings, or outcomes on our behalf. You can share what we actually do and what actually happened.
- No self-dealing. You can't earn commission on yourself, your own companies, or an arrangement made to route your own spending through your link.
- No incentivised or fake traffic. No cookie stuffing, no bots, no paid-to-click.
- Disclose the relationship. The FTC requires it, and it's the right thing to do anyway.
7. Your page
We build, host, update, and optimise your partner page. It stays ours. You get to share it, and we'd love you to. If you leave the program, the page comes down.
8. Ending it
Either of us can end this at any time, for any reason, with written notice.
If you leave or we remove you for ordinary reasons, commission already earned on collected revenue is still paid on the normal schedule, and referrals already attributed to you keep paying out for the rest of their 12 months.
If we remove you for a breach of section 6 — spam, fraud, impersonation — unpaid commission is forfeited. That's the deterrent, and it's the only case where earned money doesn't get paid.
9. The ordinary legal parts
- No guarantees. We can't promise you any particular volume of referrals or earnings.
- Our brand stays ours. We grant you a limited, revocable licence to use our name and marks to promote us honestly, and nothing more.
- Liability. Our total liability to you is capped at the commission we owe you. Neither of us is liable for indirect or consequential losses.
- Changes. We can update these terms. Material changes come with at least 30 days' notice by email, and the version at the top of this page tells you which one you're looking at.
- Governing law. The State of Ohio, and its courts.
